Orange County Probation Violation Lawyer
If you are currently on probation and you fail to appear at a mandatory court hearing (“FTA” violation), then a warrant can be issued for your arrest and your probation can potentially be revoked and you would be sent to jail. The good news is, if you were arrested for an FTA violation, you still have options. Contact our Orange County probation violation attorney and speak with us about defense against a failure to appear allegation.
Failure to Appear at Probation Hearings
There are a number of hearings you may have been required to attend for a felony or misdemeanor charge, such as:
- Formal & Informal Probation Hearing – Both formal and informal probation hearings involve the imposition of a conditional sentence in the place of the maximum penalty for the charge.
- Probation Violation Arraignment – If you fail to comply with any one of the terms of your probation, you will be required to attend a probation violation hearing/arraignment.
- Probation Modification – You may be called to a probation modification hearing to modify a term or condition of your probation.
What can happen if I fail to appear in court?
If you fail to appear in court, there are three possible things that could happen:
- You receive a warning
- The court decides to modify your probation (usually, making it stricter)
- Your probation is revoked and you go to jail
If you were accused of violating your probation for failure to appear, contact an Orange County criminal defense attorney at the Law Offices of Virginia L. Landry. You are entitled to legal counsel, and we suggest that you do not use a public defender.
Public defenders, particularly in Southern California, have heavy caseloads that do not allow them to focus their time and attention on your case. Contact our firm, and we will be able to focus our efforts on your case to achieve the optimal case outcome.
