Failure to Appear at Probation Hearings

There are a number of hearings you may have been required to attend for a felony or misdemeanor charge, such as:

  • Formal & Informal Probation Hearing – Both formal and informal probation hearings involve the imposition of a conditional sentence in the place of the maximum penalty for the charge.
  • Probation Violation Arraignment – If you fail to comply with any one of the terms of your probation, you will be required to attend a probation violation hearing/arraignment.
  • Probation Modification – You may be called to a probation modification hearing to modify a term or condition of your probation.

What can happen if I fail to appear in court?

If you fail to appear in court, there are three possible things that could happen:

  1. You receive a warning
  2. The court decides to modify your probation (usually, making it stricter)
  3. Your probation is revoked and you go to jail
