Methamphetamine, or meth, is federally classified as a Schedule II substance under the Controlled Substances Act and is illegal to possess under both federal and California state law. Under Health & Safety Code sections 11377, 11378, and 11379, it is illegal to possess methamphetamine, possess methamphetamine with intent to sell, and transport/sell/administer methamphetamine. Individuals found in possession of methamphetamine can be charged with a misdemeanor crime.

In order to be found guilty of this crime, a prosecutor must prove the following elements:

  • The defendant exercised control over a controlled substance
  • The defendant knew about the drug’s presence
  • The defendant knew that the substance was a controlled substance
  • The controlled substance was methamphetamine (in a usable amount)

A conviction of misdemeanor possession of methamphetamine is punishable by up to one year in county jail and/or probation and a fine of up to $1,000. Possession with intent to sell comes with much stiffer penalties, including up to three years in prison, a maximum fine of $10,000, and mandatory drug offender registration, among other consequences. However, these punishments may vary based on the circumstances of your case, your criminal history, and other factors.
